Abstract Mobility platforms are reshaping the digital architecture of the urban space and profoundly transforming the use, access to and offer of transportation services. In this context, mobility emerges as a powerful concept encompassing a variety of traditional and novel transportation services in an integrated, innovative, technology-intensive, data-driven, user-centric model. The typology of mobility platforms is wide and diverse, from mere aggregators of services to genuine multimodal services providers, from simple searchers to transactional environments or P2P schemes. The design and the operation of the platform is not only delineating and crystallizing the business model, but also defining the legal anatomy and the applicable rules to the platform operator, and the platform users’ activity. The aim of the article is to map the typology of mobility platforms and to describe their legal anatomy. Upon the mapping, the article dives into the legal nature of the operator in each model, identifies the main legal issues, and explores the implications of the legal design and operation on the operator’s liability as per ECJ decisions. The analysis is framed into the ongoing EU regulatory initiatives on platforms to assess their adequacy to mobility platforms and discuss the need of a sector-specific approach. © 2023 Kluwer Law International BV, The Netherlands
